1. Acceptance of Terms
By accessing or using the construction and masonry services provided by APEX MASONRY INC ("APEX MASONRY"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
2. Description of Services
APEX MASONRY provides commercial and residential masonry construction, structural block, hardscaping, and restoration services. Specific deliverables, timelines, and technical specifications are defined in individual Master Service Agreements (MSAs) or Statements of Work (SOWs) executed with our clients.
3. Property and Ownership Rights
Unless explicitly stated otherwise in a custom MSA, upon full payment for construction services, APEX MASONRY transfers ownership of the physical construction. APEX MASONRY retains ownership of all proprietary construction methods, architectural designs, and engineering schematics unless otherwise agreed upon.
4. Service Level Guarantees (SLA)
APEX MASONRY guarantees that all work will be performed in a professional manner in accordance with industry standards. We provide a limited warranty on craftsmanship as specified in the individual contract. Delays due to severe weather, material shortages, or permit approvals are explicitly excluded from strict timeline guarantees.
5. Limitation of Liability
In no event shall APEX MASONRY be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, property value, or other intangible losses, resulting from (i) your use of our construction services; (ii) any unforeseen site conditions; (iii) delays due to weather, supply chain disruptions, or acts of God.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
